Greensboro Family Law Team
Type of Case: 50-B Domestic Violence Protective Order
Case Result: Dismissed
County: Guilford County
Our Greensboro family law team was helping an immigrant father of two arrange a custody agreement with the mother of his children. Immediately after one of the court dates for their custody matter, the mother brought a 50-B charge against our client. This was an unexpected move that our legal team needed to address quickly.
50-B Consequences for Immigrant Fathers and Mothers
When a 50-B is entered against a person they may face the loss of their job as well as lose out on future job opportunities. In this particular case, our client also faced the risk of deportation because he was an undocumented immigrant. If deported, he would be torn away from his children and this was exactly the opposite of our client’s goals.
Curiously, after the mother took out the 50-B she still ended up agreeing to a custody arrangement between her and our client. The custody arrangement required significant communication between her and our client. She also wanted our client to come to her house to do the exchanges of the children. By her agreeing to terms such as this, it was clear to our team that she was not actually afraid of our client. If she were, she never would have agreed to terms such as those in a custody order. Our team knew that they could fight this 50-B and get a dismissal based on this logic.
50-B Dismissed After Successful Motion to Dismiss
At the 10-day return hearing, the mother presented her evidence as to why the 50-B charge was valid. Our family law team noted that the mother’s evidence was not up-to-par and she even ended up contradicting her witness’ testimony. Our team decided to make a motion to dismiss based on lack of evidence. The judge granted our motion and our client got to forgo testifying in court.
Now, our client no longer has a 50-B hanging over his head making him worry about losing his job or being deported. He can sleep at night knowing that he can put all of his focus and attention into caring for his two young sons.
