Property Division Attorney
Let Our Skilled Divorce Lawyers Help
One of the most complicated parts of getting a divorce is deciding who gets what. Property division can take months, particularly if the couple can’t agree with each other. Likewise, you may not be familiar with how North Carolina decides what property is eligible for property division and what property you get to keep.
Equitable Division
North Carolina is one of the states that mandates equitable division in a divorce. This means that the court will divide all your property and debt equitably, if not equally. The goal in the process is fairness, which means the court will be looking at circumstances where an equitable distribution would be unfair. It will apply a set of factors to determine the past efforts and future needs of both spouses. For example, the court will consider the following:
Marital vs. Separate Property
The property and debts that will be considered marital property will be those acquired or earned during the course of the marriage up to the date of the separation. This may include pensions, deferred compensation rights, retirement benefits, and shared living spaces.
Separate property is anything you gain or lose after separation and any goods or assets you owned before marriage. This could include any bank accounts opened prior to the marriage if you refrained from using those funds to pay for anything involving your marriage.
