The Incident

A senior citizen of Stokes County found herself with a unique problem this Holiday Season and was at a loss as to what to do. You see, back in October, she was doing her normal errands, nothing unusual, when she was cited for speeding 15mph over the limit and failing to wear a seat belt. Taking care of this type of thing was not within her knowledge base since she had not had a traffic citation in nearly 36 years. The ticket said she could pay it off. She didn’t know the pros and cons of paying a ticket instead of hiring an attorney, so she sent a check to the Yadkin County Clerk of Court and considered the matter resolved.

Things Go Awry

Like most of us, our older lady had some shopping to do for her loved ones for the Holidays. She was keeping a careful eye on her bank account throughout the Season. A week before her December court date, she noticed she had more money in her account than her records indicated she should. She carefully reviewed her accounting and realized her check to the Clerk’s Office had never cleared. Now very lost and confused about what was going on with her case, she decided to discuss it with the Clerk of Court in Yadkin County.

By happenstance, an Attorney was in the Clerk’s Office at the time of her conversation, overheard the situation, and advised her not to simply pay her ticket; but to seek a reduction instead. Her court date was scheduled for a few days after this conversation, so she showed up and explained everything to the DA herself. The Prosecutor in court that day informed her that if she attended 4-hours of driving school, they would reduce the charges to Improper Equipment. 

Our elder lady was thrilled. Everything seemed to be working out beautifully and just in time for the bulk of the Season—that is until she was in class and her check was cashed. Not only had her check been cashed but the Court had mistakenly suspended her license for 30 days since her speed was a “suspendable offense.” The suspension had been sent off to Raleigh and was in effect before she discovered the mistake.

Traffic Attorney Manages a Holiday Miracle

Our soon-to-be client had been less than diligent about checking her mail and had missed the notification informing her of her license suspension until 2 days after it went into effect. Unfortunately, this was also 2 days before Christmas. Our kindly senior citizen was in a panic. She worked as a Social Worker and also for the US Census and needed desperately to drive legally. The Improper Equipment replaced the speeding conviction, ultimately saving her 3 points on her license and insurance. In the long run, this also saved her a lot of money on her premiums.
